The Institute's Code of Fundraising Practice, 'Best Practice for Fundraising Contracts' (310kb) and accompanying model contract sets out legal and best practice requirements for fundraising contracts (which may be between a charity and a consultant, professional fundraiser, professional fundraising organisation or agency).
The Institute's Standard Forms of Agreement are draft model contracts for commercial participations and freely available to all.
The Agreements are in model form and the Institute strongly recommends that they should be adapted for individual circumstances, in which case appropriate professional advice should be taken.
The accompanying Guidance Notes (95kb) should be read and understood in the first instance.
Charities and voluntary organisations should be aware that under the Charities Act 2006, there will be new legal requirements for professional fundraisers and the statements they will be required to make when fundraising.
More information will become available from the Office of the Third Sector in the second half of 2007. In the interim, charities should consult the document Charities Act 2006: What Trustees Need to Know.
